Agreement for the Provision of an Independent Financial Adviser Framework

The Service Users Financial Affairs team manage the finances of over 230 service users either with an Appointeeship for benefits, with a General Power of Attorney or by a Deputyship Order issued by the Court of Protection.

The Deputyship Order and General Power of Attorney are for the full management of a service users financial and property affairs.

Under the Office of the Public Guardian’s Deputy Standards the Deputy is required to have access to appropriate advice and expertise on investment, savings and property.

Currently the team utilise the Court Funds Office and Cash ISA’s for Deputyship cases and Cash ISA’s for all other service users.

However, Court Funds interest is at an all-time low so this is considered no longer a competitive and primary investment option for service users who have significant capital to invest.

In addition the team have no financial advice training.

The Service Users Financial Affairs team require a process and framework to enable it to procure a financial product on behalf of a service user whether independently or by appointing a third party financial adviser to act on behalf of a client.
