The brief

Tenders are invited from interested parties for the provision of an Eatery Facility at Keele In Town, which is part of the University of Keele, in accordance with the Concession Agreement and the Lease Agreement' referred to in Sections 2 and 3 of the Invitation to Tender (ITT) documentation.

The agreement for the provision of an Eatery Facility will operate on a concession basis (a Concession Agreement).

Tenderers should therefore note the following critical prerequisites: The consideration (payment) to the appointed Tenderer ("Concessionaire") will consist solely in the right to exploit the services that are the subject of the Concession Agreement.

There will be no payment made by the University to the Concessionaire for the purpose of fulfilling the obligations pursuant to the Concession Agreement.

The University intends to grant a Lease to the Concessionaire, and the University and Concessionaire shall enter into the Lease.

It is intended that the obligations pursuant to the Concession Agreement will only come into force on completion of the Lease by the Concessionaire for a fixed period of 5-Years from the effective date (1 October 2024).

The University will transfer to the Concessionaire the operating risk in exploiting the services, and the Concessionaire will pay Rent and Service Charges in return for the exclusive right to commercially exploit the services for the provision of an Eatery Facility at Keele In Town.
